We recall that our anarchist comrade Gabriel Pombo Da Silva was arrested in Portugal on January 25th, after a year and half of clandestinity.
During his confinement in the cells of the Porto judicial police station the defense has worked for his immediate release as the law “provides”. But, as we already know, that right is inversely proportional to power and Portugal has clearly demonstrated to be under the power of the Spanish State that wants to completely annihilate our comrade. They haven’t done it after 32 years behind bars, nor with isolation, torture and humiliation of all kinds, how can they think they will do it now!?
Mrs. Mercedes Alcázar Navarro (judge of court number 2 of Girona), in any case, is working hard on it and, for now, thanks to the close and subordinate collaboration of her Portuguese colleagues, has managed to convince the Lisbon Supreme Court to give in to her reasoning.
Today, March 27, we have learned that the aforementioned court has pronounced in favor of Gabriel’s extradition to the Spanish State. In fact that has finally been confirmed to us that this final judgment has been the fruit of the close collaboration of these two countries, and the issuance of the judgment took only 3 days (an appeal was presented by the defense on March 5th, received the following day, then was in the hands of the competent judges on March 23rd, and the sentence signed on March 26th!!!).
We are always convinced that it is state revenge against Gabriel, for him not having bowed to the authorities and for having faced with dignity and head held high an entire life in prison claiming his anarchism and coherence.
We will not waste any more time reflecting and writing about what is “judicial authority”, with what it has stopped doing, analyzing, examining, consider, etc … We remember, in any case, some fundamental points so that the reader does not lose track of the situation:
– The judge of court number 2 of Girona, Mercedes Alcázar Navarro, demands that Gabriel serve another 16 years in prison, which denies the “specialty principle” (thanks to which he was released 4 years ago), and which has not lost homogeneous legal validity throughout Europe. This same legal principle has been continually denied by the Guimaraes regional court (judges María Teresa Coimbra, Cándida Martinho, Antonio Teixeira) and the Tribunal Supreme Court of Lisbon (judges Helena Moniz and Nuno Gomes Da Silva).
– The judge of the aforementioned Girona court, Mercedes Alcázar Navarro, hid Gabriel’s immediate release order in May 2016 (for this it took 3 more weeks for Gabriel to be released), which is why this move of hers was denounced for “prevarication” (her attitude seems clearer now- revenge). This Navarro, in addition, during these last two months has not stopped putting pressure on Portugal in order to have Gabriel handed over to her. “This most dangerous individual”.
– Now, the defense will resort to the Constitutional Court, but it will be very difficult to modify the conclusion of the Supreme Court. Extradition will be suspended until the constitutional sentence is issued (more or minus a couple of weeks).
Gabriel is in good health and always accompanied by his combative spirit combative… Let’s continue expressing all our solidarity without letting this beautiful word be trapped in an empty shell. We do not lower our guard and we always expect the worst of our enemies; we are not naive and we know that we have to resist and fight to the end.

After the arrest of our comrade anarchist on January 25th, in Portuguese territory, Gabriel is in prison with a request for extradition to the Spanish State. With the decision of the Portuguese Court of Foreign Affairs of Guimeraes, the extradition procedure continues, having a period of 5 days to appeal to the Lisbon Supreme Court.
Gabriel is strong and ready to wage this new battle for his freedom and for this reason we summon you to the rally at the Consulate of Portugal in Barcelona this TUESDAY MARCH 3rd, at 12am in Ronda de Sant Pere 7 (Metro Urquinaona), to demand its immediate freedom and express our unanimous rejection of its extradition.

One month after the arrest of our comrade Gabriel, who was detained on January 25 in Portugal, the Guimaraes court has ruled in favor of extradition to the Spanish state.
This news does not surprise us, considering the active revenge of the Judge Mercedes Navarro of court number 2 of Girona against Gabriel. This Judge is the same one who, in May 2016, ordered the then Dueñas prison director (of Palencia) to hide the order of Gabriel’s immediate release. Gabriel, after 3 weeks of being “kidnapped” finally tasted freedom on June 16 (for this reason the Navarro was denounced for “prevarication”).
During this last month, Navarro has not stopped pressuring Portugal in order to consign “this very dangerous individual”.
We remember that the main objective of the defense is to obtain Gabriel’s freedom under the “special principle” (thanks to which he was released four years ago without it losing legal validity) and, in any case, avoid extradition, given the Portuguese nationality that Gabriel has recently obtained (Portugal should not extradite its own nationalized citizen).
Neither the principle of specialty nor the Portuguese nationality have been taken into consideration by the court of Guimaraes, which has been limited to giving us the reason to later conclude that it must proceed to the extradition (that is, it cannot resist indifferently to the pressure of Mrs. Navarro).
The lawyer is presenting the appeal to the Supreme Court of Lisbon and until this is pronounced (around a week) Gabriel will remain detained by the judicial police of Porto.
We continue to express all our solidarity … And so that it is not left as an empty word!

Whilst awaiting more news, his lawyer – who is in solidarity with Gabriel – has anticipated that the amount necessary for the defense will be considerable. You need to rely on and pay punctually those professionals with whom you are obliged to work; and we cannot act without the competing lawyers from Portugal and most likely from Germany.
Therefore, a constant amount of money is urgently needed to manage all the bureaucracy that involves the administrations of justice from three different countries (Spanish State, Germany and Portugal).
Currently the legal situation is as follows:
The Girona prosecutor’s office intends that Gabriel spends another 16 years in jail due to the interpretation of a fusion of non-existent penalties. This denies a special principle (one of the legal reasons why it was possible that Gabriel was released in June 2016), which must be claimed by Germany at the request of Portugal, if optionally, they consider it appropriate.
The extradition order will be frozen while Portugal analyzes the situation, consults Germany about the “special principle” and determines in the situation whether to extradite him or not.
The objective of the defense is the immediate release of Gabriel by recognition of the same “special principle”. If that was not achieved, the objective would be to avoid extradition and serve any supposed outstanding penalty in Portugal, avoiding the harassment that awaits him in the prisons of Spain.
In case of extradition, it would be fought so that this penalty was not fulfilled, applying any redemptions and mergers that until today have not been accounted for, an action that could also be implemented if it met with approval in Portugal.
In any case, you have to work legally so that no prosecution can reopen any previous case and end any possible order of arrest.

On Monday, January 27, 2020, the trial against our comrade began on Portuguese soil, the first stage during which the following emerged in summary.
– Portugal has so far accepted the paralysis of extradition to the Spanish state and the defence has about 20 days to add documentation that further supports the importance of non-extradition.
– The defence has immediately challenged the calculation of the residual penalty that the Spanish State claims to apply to our comrade, namely 16 years! Without going into too much legal detail, it can be seen from the documentation justifying this count, that it is a “legal revenge” (but what state revenge is not?).
– For the moment, Gabriel remains detained at the Oporto Judicial Police, waiting to appear before the judge more or less in mid-February. He can receive visits every other day from anyone. He is well and he is strong, combative, determined and ironic as always!
On the same morning of Monday, January 27, the houses of Elisa Di Bernardo’s mother, father, sister and brother-in-law were searched with the aim of seizing computer equipment. The public prosecutor’s office of Brescia issued yet another 270bis [subversive association with purpose of terrorism or subversion of the democratic order] for Elisa and Gabriel accusing them of belonging to a subversive cell with international base and support (the earth shakes, it shakes!). This new (but old, crushed and retracted) repressive wave obviously does not facilitate Gabriel’s legal situation and the regime press of the three countries has already done its duty by exalting the close investigative collaboration between Italy, Spain and Portugal.
To journalists, our historical enemies’ puppets, their duty… to us our revolutionary duty (and let each one call it what he wants, je je).

The clandestinity of anarchist comrade Gabriel Pombo da Silva has ended
After about a year and a half in hiding, this morning, January 25, 2020, Gabriel Pombo Da Silva was arrested in Portuguese territory.
With an international arrest warrant for a residual theoretical sentence of over ten years (a personal vendetta converted into a “legal detail”), Gabriel continued to contribute to the anarchist struggle with his writings.
He is currently locked up in a cell of the judicial police in Porto waiting to appear on Monday in the courtroom where the possible extradition to Spain will be discussed.
Gabriel is well and quite calm in spite of everything.

“Black December” is now 10 years old and Mauricio Morales was the detonator.
Do you remember? They haven’t stopped, those ideas and practices that rose (in)surged from the collective desire proposed by multiple anarchic individuals who put it to the test.
Indeed, the struggle is an essay that claims its execution and that must be experienced through practice to understand all the potentials that it offers us. Theorisations that are not tested in practice will always remain unknown.
We have verified (in/with praxis) that determination (individual will) can generate common moments and framesworks of collective struggle through active propositions. The problems in the (at least in what is committed as the F.A.I.–F.R.I.) project begins when it’s own postulates proposed by this informal organization model are ignored. They are:
1 – Seditious solidarity.
2 – Anarchic campaigns.
3 – Communication between groups and related individuals.
We know that the informal organization (also called T.I.A. in Latin America) at an international level (with or without acronyms) has its limitations, especially when the various insurgent tendencies are inclined to dispute discursively between themselves instead of complementing each other, both in the theoretical as in the practical.
Total liberation does not mean alienation or fratricidal alienation or competition among the active groups.
Who in one way or another rejoices in the end of “obrerismo mendicante”, which delegated all activism to obsolete organizations in the era of technological capital. We see in the years of the new anarchism of praxis that appeals are of no use for ourselves.
It is not a reflection of what it says. Be what is said and say what is done, it is what makes the verb meaningful and gives weight to the word.
I once read somewhere about: “Language creates a reality and reality creates a language… “.
This they have understood (even better than us) those Italian inquisitors and hence their fixation with public debates and what everyone wrote.
[Operation] “Ardire” (because it is bold to talk about what we dream), “Scripta Manent” (because the written word endures) and thus all the repression of this last decade has been limited to prosecuting all that is desired, everything written or said and aimed at all sabotage carried out by anarchists.
Unfortunately, what is written as much as it remains (if not assumed so in the first instance) does not alter material reality… and, unfortunately, interpretive juggling either. Or put another way: the chemical formula of the tritolo is not tritolo.*
We are already getting used to repeating slogans (“Fight Week”, “Black December”, etc.) without worrying and worrying about the most important: our affinity groups and practical organization.
A – Procure material and economic means.
B – Carry out anarchic campaigns and do not start a new proposal until the previous one is terminated.
Only acting as one hand will each finger have power and sense.
I do not question other groups of the “Anarchist Galaxy” but, only and exclusively, those that are inspired by the F.A.I./F.R.I./C.C.F. to act.
Our power can only be in the sum of action groups that act coordinated on all three points.
We must recognize that the legacy (both theoretical and practical) of the subversive project F.A.I.-F.R.I.-C.C.F., is here to stay.
In addition, both “Black International Editions”, and “Black International of Praxis” continue their editorials and mutual knowledge.

The heretic, like the bandit, knows that the loss of his freedom takes him irremediably to the gallows. What awaits him is a tribunal that will ask him about his actions. A court that will exercise its power and absolute reason in the name of God, the People, the Kingdom and the State. Power and reason are acts of authoritarian syncretism developed throughout the course of the centuries by the proprietors of the Earth, the Sea and the Sky. Therefore the individualist anarchist – who is at the same time heretic and bandit – is aware that his conviction on power and reason takes them to the stake. Like a moth, they seek light and succumb. Like Icarus, they fly high and the Sun melts their wings. Like Prometheus they steal the fire of the gods for themself and for the others; like him.
The anarchist’s drama is his passion for freedom, his unrelenting search for accomplices, whom he rarely finds. She/he despises the conformism of the herd, the cowardice of the crowd, the dogmatism of every faith.
Any priest – of every ‘ism’ – hates her because they can’t be controlled, she/he doesn’t obey him, he/she doesn’t listen to him; and when he/she can, she/he raises their voice to attack the slightest form of power and authority. Sometimes these solitary avengers throw a bomb or plunge a dagger with the intent – always – of sowing chaos into the order of reason, rigorously established as law or supreme truth. At other times, they mingle with discontent with the intent to trigger insurrections.
But they use most of their time reading, because their best friend and hobby is the knowledge of what was and what is. They do not have illusions or hopes, but convictions. They know that knowledge is their strength and that it gives them self-determination.
They live each day as if it were their last. In an enslaved society, Freedom is punishable with death. They don’t resign themselves, they don’t complain, they curse, attack, expropriate. There aren’t many of them, but even these few can preoccupy all governments, precisely because they are ungovernable; in love with total freedom. What was doesn’t matter. They reinvent themselves at every step, every shot, every kiss. They are not strategists because they do not have a final goal and, therefore, their actions arouse the anger of others.
They have no ‘partisans’ other than those who know and love them, apart from their barbarian iconoclasts. Often, they are caricatures in newspapers, from the moment that they are thought to be able to prevent people asking: who are these madmen/women? What do they want? How to explain who anarchists are to citizens who delegate their lives and thoughts to others?
Yes, they are mad and they don’t want anything less than nothing. Everything that has been taken from them and nobody can give back. There they are! They have no ‘arguments’, fire and powder speak for them. A kilo of dynamite and a poem. A kilo of black powder and a new heresy. A ‘Hands up’ and they are off. Machines that destroy their banks, courts, police stations; Barracks, churches and political seats… ‘What do these madmen/women want?’ Nothing! The destructive nothing which leaves space to wild nature. Flowers eat their way under the ruins of their putrid ‘civilization’.
